Data Protection Notice For Customers
This Data Protection Notice ("Notice") sets out the basis on which Real Capital Property ("RealCap", "we", "us", or "our") may collect, use, disclose or otherwise process personal data of our customer in accordance with the Personal Data Protection Act ("PDPA").

This Notice applies to personal data in our possession or under our control, including personal data held by organisation that we have engaged to collect, use, disclose or process personal data on our behalf.
PERSONAL DATA
For the purpose of this Notice :
1) "customer" means an individual who
(a) has contacted us through any means to learn more about our services, or
(b) may enter, or has entered, into an agreement with us for the supply of any goods or services.

2) "personal data" means data, whether true or not, about a customer who can be identified from
(a) that data, or
(b) that data and other information to which we have or are likely to have access.

3) Depending on your interaction with us, the personal data we may collect includes your name, contact number, email address, and any other information provided through our forms, communication channels, or services requests.

4) Other terms used in this Notice shall have the meanings given to them in the PDPA.
COLLECTION, USE AND DISCLOSURE OF PERSONAL DATA
We generally do not collect your personal data unless :
5) you provide it to us voluntarily, either directly or through an authorised representative, after being informed of the purposes of collection; or

6) collection, use or disclosure without consent is permitted or required by the PDPA or other laws.

7) We will seek your consent before collection additional personal data or using your personal data for purposes not previously notified (unless authorised by law).

8) We may collect and use your personal data for purposes including:

a) performing obligations connected to the services you have requested;
b) verifying your identity;
c) responding to and processing your enquiries, requests or feedback;
d) managing our relationship with you;
e) providing real estate guidance, update, or follow-up on services you have expressed interest in;
f) contacting you regarding property-related services, events, or professional support.
9) We may disclose your personal data:

a) where necessary for performing services requested by you;
b) to our agents, partners or service providers who assist us in delivering our services;
c) where required or authorised under applicable laws.
RETENTION OF PERSONAL DATA
10) We retain personal data for as long as as necessary to fulfil the purpose for which it was collected, or as required or permitted by law.

11) We will cease to retain personal data, or remove identifying information, when it is reasonable to assume that retention is no longer necessary for business or legal purposes.
WITHDRAWING YOUR CONSENT
12) Your consent remain valid until withdrawn in writing.
You may withdraw consent by contacting our Data Protection Officer ("DPO") using the details provided below.

13) Upon receiving your request, we may require reasonable time to process it and will inform you of any potential consequences, including circumstances where withdrawal of consent may affect service delivery.

14) Withdrawing consent does not affect our right to retain or process personal data where such use is permitted or required by law.
ACCESS TO AND CORRECTION OF PERSONAL DATA
15) You may submit a request to access or correct the personal data we hold about you by contacting our DPO.​

16) We will respond within thirty (30) business days or notify you if additional time is needed. If we are unable to fulfil your request, we will inform you unless exempted under the PDPA.
PROTECTION OF PERSONAL DATA
17) We implement reasonable administrative, physical and technical measure to safeguard your personal data against unauthorised access, use, disclosure, modification or loss.​

18) However, no method of electronic transmission or storage is completely secure. While we strive to protect your data, we cannot guarantee absolute security.
ACCURACY OF PERSONAL DATA
19) We rely on the accuracy of personal data you provide.​​However shall there be any changes to the personal information please inform our DPO to request for amendments.
TRANSFER OF PERSONAL DATA OUTSIDE OF MALAYSIA
20) We generally do not transfer personal data outside Malaysia.​

21) If such a transfer becomes necessary, we will seek your consent and ensure that your data receives protection comparable to that provided under the PDPA.

This Notice supplements, and does not supersede, any consent terms or contractual provisions related to the collection and use of personal data.
